I was travelling to my hometown when I found out I got maximum grade and was admitted first with full state tuition at the International Arbitration LLM program. This comes as no surprise for three reasons. First, I had it on my “to do” list since July. Until now, there was not one single thing I had in mind that I did not succed in concretizing.
Second, the exam comprised of an exam of the new ICC Rules and of the UNCITRAL Model Law on International Commercial Arbitration. This seemed quite easy for me as I had written in March 2012, right after the entry into force of the new ICC Rules, an article on the Novelties Introduced by the 2012 Rules of Arbitration of the International Chamber of Commerce, which I also presented in front of a renowned jury presided by Prof. Corneliu Birsan, judge at the European Court of Human Rights.
I remeber nobody knew anything about these new Rules. They had entered into force for four months and they only applied to arbitrations started after 1st of January 2012. There were probably no arbitration according to the new Rules that at that time in Romania. Of course, Prof. Birsan was the only one asking me questions which I was so proud of responding to. As the most important novelty of the new ICC Rules is the introducing of the Emergency Arbitrator, he asked me: “It would be interesting to know who appoints this Emergency Arbitrator and which is the term for such appointment” and I answered according to art. 2 para. (1) of the newly introduced Appendix V – Emergency Arbitrator Rules that the President of the Court of Arbitration (by the International Chamber of Commerce) appoints the eergency arbitrator in maximum two days from a application being received by the Secretariate of the Court.
As for the UNCITRAL Model Law on International Commercial Arbitration, it was widely referred to during the lectures of the Hague Academy of Private International Law which I attended this summer (third).
